General Terms and Conditions (GTC)

1. general

The scope of the business relationship between customers and the hairdressing salon About Hair, Pascal Schymick is governed exclusively by the following General Terms and Conditions (GTC).
These General Terms and Conditions apply to all actions in the salon, such as the services and the sale of products, as well as contracts and offers that come into being or are concluded between the hairdressing salon About Hair and the Client. Exceptions that are not covered by the General Terms and Conditions of Business require an agreement in writing. Deviating, conflicting or supplementary terms and conditions shall not become part of the contract unless their validity is expressly agreed to in writing.

 

2. SERVICES

Salon About Hair performs its services to the best of its ability. Products of the industry are used, which correspond to the current quality standard. Changes will be brought to the attention of the customer by Salon About Hair even before the start of the service to be performed.

 

3. DATES

Salon About Hair works mainly by appointment. The customers are offered appointments after specifying the services requested by the customer. After acceptance of the appointment by the customer, it is then firmly reserved with date, time and the desired services.
This can be done in person, by phone (+49 211 / 36 77 75 30 or +49 211 / 33 67 332) or via a booking tool on the homepage www.abouthair.de. Once the appointment is reserved, a service contract is created between the client and Salon About Hair.
For certain appointments (e.g. wedding / hair thickening / hair extension), the customer is required to pay in advance. This will be communicated to the customer when the appointment is made. These appointments are optional only until payment is received and may be canceled and cancelled by Salon About Hair until full payment is received.
Appointments that have not yet been paid for can be postponed by either party with 24 hours‘ notice. This must be done by telephone or in writing.

If due to a fault (e.g. absence or late arrival) of the customer the agreed services cannot be performed due to lack of time, Salon About Hair is entitled to withdraw from the contract and to charge an appointment cancellation fee in the amount of 80% of the scheduled services. For hair extension services for which the salon had to purchase the custom merchandise and which were prepaid or paid for in advance, the appointment cancellation fee is 100%.

4. PRICES & PAYMENT

The prices for services are inclusive of the respective statutory value added tax. Prices from SALON About Hair can be viewed publicly at any time in the salon or at www.abouthair.de. For services that are not described in the price list, Salon About Hair will be happy to provide information about the planned price in advance.
The prices listed are minimum prices and may increase due to additional work (e.g. long or particularly thick hair, etc.) or spontaneous addition of further services. Invoice amounts, if not paid in advance, are due immediately after performance of services and are payable exclusively in cash, by EC cash, credit card or voucher.

 

5. GOODS

Paid vouchers / purchase vouchers:
Customers can purchase vouchers in the salon About Hair. Paid vouchers can be redeemed like cash for payment of all services and items at Salon About Hair.
Promotional and action vouchers and discounts:
Salon About Hair sometimes offers promotional coupons and discounts. These benefits may be subject to certain conditions or deadlines. The acceptance of these promotional and promotional vouchers or the granting of discounts to the customer is Salon About Hair free.

 

6. UNDERAGE CUSTOMERS

Under the age of 16, Salon About Hair can only serve services involving color or bleaching with the written consent of the parent or guardian.

 

7. WARRANTY

If a defect appears, the customer must immediately notify Salon About Hair. A complaint is considered to be immediate only if it is made no later than 5 days after the service or purchase.
The About Hair salon is then entitled to a right of rectification.
The choice of whether to touch up or refund all or part of the cost is solely up to Salon About Hair.
If, after a complaint has been made, Salon About Hair offers to rectify the defect and the customer refuses to do so, the customer, by refusing, waives any further claims for defects and repayment. If the customer does not respond to an offer of rectification within 48 hours, this shall be deemed a rejection of the rectification.
No claims for defects shall exist in the case of only insignificant deviation from the agreed performance or quality, as well as in the case of only insignificant impairment of usability. This also applies to natural wear and tear as well as to damage resulting from incorrect or negligent handling, excessive use, unsuitable hair and skin care products by the customer or due to special influences.
If rectification work or modifications are carried out by customers or third parties, there shall also be no claims for defects for these and the resulting consequences.

 

8. WARRANTY

The customer receives a guarantee period of 5 days for the service provided.
This warranty is void if the customer does not use the products used and recommended in the salon. When using products even from well-known drugstore chains, hair can be affected if they contain silicones, which can remove the color from the hair.

 

9. PERSONAL DATA AND PRIVACY

The client assures to disclose to Salon About Hair all personal data and information relevant to the professional performance of the service.
These data are stored in the customer file in electronic form. Salon About Hair undertakes to use this data only for the purpose of the service to be provided, taking into account the privacy clause, and not to disclose the data to third parties or outside persons without the written consent of the customer. Compliance with the data protection regulation is assured.

 

10. LIABILITY

Salon About Hair assumes no liability for wardrobe, bags, luggage and valuables of customers. Jewelry must be removed before treatment begins.
Salon About Hair assumes no liability for clothes of customers if they are damaged through the fault of the customer, the same applies to any intolerances and allergies, whether known or unknown.
Exclusion of liability exists for chemical, thermal, hair and skin cosmetic treatments expressly requested by the customer, as well as for all special hairdressing measures.
In the event of circumstances beyond the control of Salon About Hair, e.g. illness or force majeure, such as power outages and the like, which partially or completely prevent the fulfillment of a customer order, no liability claim can be derived. Salon About Hair also assumes no liability for appointment postponements or delays for which Salon About Hair is not responsible. If Salon About Hair has to postpone an appointment, the customer will be informed as early as possible. The customer then has the option to agree with Salon About Hair on the new appointment or to cancel the appointment free of charge. If the client has already paid for the appointment or paid in full, all monies for unused services will be returned to the client.
Salon About Hair tries to schedule appointments so that the appointment can start on time. Due to unforeseeable events, the customer may have to wait.
A claim for damages cannot be derived from this

 

11. DAMAGE AND THEFT

Salon About Hair has the right to claim compensation for all damages caused by the client. Shoplifting will be reported immediately.

 

12. PICTURES

If Salon About Hair publishes image examples in the salon or on the homepage, these are only examples. Even if the hairstyle or color is refinished on the client, there may be variations in design, shape and effect of the design on the client. The result may differ from the image shown. The copyright for the design remains with Salon About Hair. Should the customer make photographs of the created design, which are used for commercial purposes (Internet, publications, etc.), this requires a written declaration of consent by Salon About Hair. In the event of failure to do so, Salon About Hair may make reasonable claims.

 

13. BEHAVIOR

The customer undertakes to behave appropriately during the visit to the salon. If the customer continues not to behave appropriately even after a warning, Salon About Hair has the right to expel the customer from the salon and, if necessary, to ban the customer from the premises.

 

14. FINAL CLAUSE

Should individual provisions of these general terms and conditions be wholly or partially void, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that is lawful and comes as close as possible to the meaning of the invalid provision.
